{"id":8071,"date":"2024-12-12T15:54:08","date_gmt":"2024-12-12T15:54:08","guid":{"rendered":"https:\/\/emn.org.uk\/?p=8071"},"modified":"2024-12-12T15:54:08","modified_gmt":"2024-12-12T15:54:08","slug":"muckle-llp-the-procurement-act-2023-central-digital-platform-news-for-authorities-and-suppliers","status":"publish","type":"post","link":"https:\/\/emn.org.uk\/2024\/12\/12\/muckle-llp-the-procurement-act-2023-central-digital-platform-news-for-authorities-and-suppliers\/","title":{"rendered":"Muckle LLP: The Procurement Act 2023: Central Digital Platform \u2013 news for authorities and suppliers"},"content":{"rendered":"<p>The light is slowly dawning on the way in which the Central Digital Platform will work under the new Procurement Act 2023 (Act).<\/p>\n<p>The latest\u00a0<a href=\"https:\/\/assets.publishing.service.gov.uk\/media\/6720fe0a3758e4604742a8ab\/20241029_CDP_Factsheet_v1.0.pdf\" target=\"_blank\" rel=\"noopener\">missive on the CDP<\/a>\u00a0from the Cabinet Office gives the first inklings of the type of functionality we can expect and how\u00a0<strong>Suppliers<\/strong>\u00a0will share their information with\u00a0<strong>Authorities<\/strong>\u00a0using the platform.<\/p>\n<p>Whether you are a\u00a0<strong>Supplier<\/strong>\u00a0or an\u00a0<strong>Authority<\/strong>, here are our top 10 things you need to know about the system which goes live in February 2025:<\/p>\n<ol>\n<li>The platform will still be called \u201cFind a Tender\u201d and will be an update to the existing Find a Tender Service at\u00a0<a href=\"https:\/\/www.gov.uk\/find-tender\" target=\"_blank\" rel=\"noopener\">https:\/\/www.gov.uk\/find-tender<\/a>. It is currently in a stage of beta testing with a number of private beta users.<\/li>\n<li>It will be linked to many existing e-sender portals currently in use, so if you currently use a portal which links directly with Find a Tender, this is likely to continue to be the case. Your portal provider may already have been in touch to update you on this.<\/li>\n<li>Each\u00a0<strong>Authority<\/strong>, each procurement and each\u00a0<strong>Supplier<\/strong>\u00a0will have a \u201cUnique Identifier\u201d code which will be issued by the platform so that information can be easily linked and followed through the contracting journey online.<\/li>\n<li>The system will not simply be for the publication of procurement notices, but will allow the uploading of documents by\u00a0<strong>Authorities\u00a0<\/strong>(such as copies of contracts).<\/li>\n<li><strong>Suppliers<\/strong>\u00a0must be registered on the system in order to be awarded a contract.<\/li>\n<li><strong>Suppliers\u00a0<\/strong>will need to register and then input detailed information which they would usually be required to share as part of a PQQ or SQ process with an\u00a0<strong>Authority<\/strong>. Information such as convictions, conduct and contract breaches need to be input as part of the generic \u201cexclusion grounds\u201d information under the Act, and accounts, financial information, qualifications and accreditations will also be stored on the system.\n<p>This will include information about connected persons of\u00a0<strong>Suppliers<\/strong>\u00a0(i.e. their directors, shareholders and others with significant control).\u00a0<strong>Suppliers<\/strong>\u00a0are themselves responsible for keeping that information up to date, and there is no process of verification of the information undertaken by the Cabinet Office.<\/li>\n<li>When it comes to a procurement a\u00a0<strong>Supplier<\/strong>\u00a0will download a \u201cshare code\u201d or a full file of the information stored on the platform, and share the access code with the\u00a0<strong>Authority<\/strong>\u00a0so that the\u00a0<strong>Authority<\/strong>\u00a0can access and view the information online.\n<p>Alternatively, depending on the\u00a0<strong>Authority\u2019s<\/strong>\u00a0instructions,\u00a0<strong>Suppliers<\/strong>\u00a0might need to send the complete information file electronically to the\u00a0<strong>Authority<\/strong>\u00a0for them to review and evaluate. So,\u00a0<strong>Supplier<\/strong>\u00a0information will not be accessible to all\u00a0<strong>Authorities<\/strong>, only to those whom the\u00a0<strong>Supplier<\/strong>\u00a0issues and authorised share code or the full file.<\/li>\n<li><strong>Suppliers<\/strong>\u00a0will not be able to complete bids or communicate with\u00a0<strong>Authorities<\/strong>\u00a0using the platform \u2013<strong>\u00a0Suppliers<\/strong>\u00a0will need to check the tender documents for each procurement in order to find instructions on how to complete and submit their tenders and raise queries with the\u00a0<strong>Authority<\/strong>.<\/li>\n<li>As an\u00a0<strong>Authority<\/strong>, if you are already registered on Find a Tender, you will need to re-register onto the Platform.\u00a0<strong>Authorities<\/strong>\u00a0should start to register from January 2025 and the Cabinet Office will issue further instructions on this in due course.<\/li>\n<li><strong>Suppliers<\/strong>\u00a0only need to register at the point that they want to bid for a contract after the Act comes into force on 24 February 2025.
